1. Introduction

Welcome to Derak.my (“Derak”, “we”, “our”, or “us”).
By making a booking with us, you agree to be bound by these Terms & Conditions.

These Terms are governed by the laws of Malaysia.

2. Booking & Confirmation

2.1 All bookings are subject to availability.
2.2 A booking is only confirmed after:

  • Required deposit or full payment has been received; and

  • Official confirmation has been issued by Derak.my.

2.3 We reserve the right to decline any booking at our discretion.

3. Payment Terms

3.1 Payments may be made via:

  • Bank transfer

  • Approved online payment gateways

3.2 Deposit payments are strictly non-refundable unless otherwise stated.

3.3 Full payment must be completed before the travel date as stated in your booking confirmation.

Failure to complete payment may result in automatic cancellation without refund.

4. Cancellation & Refund Policy

4.1 Customer Cancellation

If cancellation is made:

  • 30 days or more before travel: Deposit forfeited

  • 14–29 days before travel: 50% of total payment forfeited

  • 7–13 days before travel: 70% of total payment forfeited

  • Less than 7 days before travel / No-show: 100% forfeited

All cancellation requests must be made in writing via WhatsApp or email.

4.2 No-Show Policy

Failure to arrive on the travel date without prior notice will result in 100% forfeiture of payment.

4.3 Weather & Sea Conditions

Pulau travel is subject to weather and sea conditions.

If:

  • Authorities close the jetty

  • Marine department suspends boat services

We will assist to reschedule your trip (subject to availability).

Refunds due to weather are not guaranteed and depend on third-party providers (resorts / boat operators).

Derak.my is not liable for natural conditions beyond our control.

5. Force Majeure

Derak.my shall not be held liable for failure to perform obligations due to events beyond reasonable control, including but not limited to:

  • Natural disasters

  • Storms / rough sea conditions

  • Government restrictions

  • Pandemics

  • Political unrest

  • Transportation disruption

No compensation shall be payable in such circumstances.

6. Changes to Itinerary

We reserve the right to:

  • Modify schedules

  • Replace accommodations with similar standard

  • Adjust activities

Due to operational, safety, or weather reasons.

Such changes shall not entitle customers to refunds.

7. Liability Limitation

7.1 Derak.my acts as a travel coordinator between customers and third-party providers (resorts, boat operators, activity providers).

7.2 We shall not be liable for:

  • Injury, loss, or damage during activities

  • Personal accidents

  • Loss of personal belongings

  • Delays caused by transport providers

  • Negligence of third-party operators

Customers participate in activities at their own risk.

8. Travel Insurance

Customers are strongly advised to purchase personal travel insurance covering:

  • Medical emergencies

  • Accidents

  • Trip cancellation

  • Personal belongings

9. Customer Responsibility

Customers must:

  • Provide accurate personal information

  • Arrive at meeting points on time

  • Follow safety instructions

  • Ensure children are supervised

Failure to comply may result in termination of services without refund.

10. Media & Marketing

Derak.my may take photos or videos during trips for marketing purposes.

If you do not consent, you must inform us in writing before the trip date.

11. Pricing & Errors

We reserve the right to correct:

  • Pricing errors

  • Typographical mistakes

  • Package descriptions

If pricing errors occur, we may cancel the booking with full refund of payment made.

12. Dispute Resolution

Any disputes arising shall be governed by Malaysian law.

Both parties agree to attempt amicable resolution before legal proceedings.
